Your rights under the Australian Consumer Law are important to us and are not impacted by our Terms & Conditions. If any part of these terms is found to be invalid or unenforceable, it will be removed, while the rest of the provisions will remain in full effect.

We're committed to providing top-quality services while ensuring transparency and clarity for our valued customers. Please take a moment to review our terms and conditions to ensure a smooth and satisfying experience with us.

Limitations of Warranty

 

Retic Smart provides a 12-month warranty for the workmanship of the installation of new components, while products are subject to the manufacturer's own warranty.

​

Retic Smart warrants its repair and maintenance services to be free from defects in workmanship for a period of one year from the date of completion. However, please note that our warranty does not cover maintenance work after the service is complete, including but not limited to:

​

  • General system maintenance and troubleshooting

  • Cleaning of sprinklers and nozzles

  • Adjustments to irrigation schedules and watering times

  • Repair of new leaks, new broken pipes, and additional malfunctioning components

  • Damage caused by misuse, abuse, or neglect, including but not limited to:

    • Exposing the controller to water​

    • Intentional damage to system components

    • Failure to follow the manufacturer's instructions for use and maintenance

​

Please be aware that damage caused by acts of nature, vandalism, or theft, as well as wear and tear due to normal use, are also excluded from our warranty coverage.

Scope of Work

 

Retic Smart is committed to fulfilling the work outlined in the original contract as detailed in the provided quote. It's important to note that while we strive to provide accurate estimates, unforeseen circumstances may arise during the course of the project.

​

The initial quote serves as an estimate based on the information available at the time of assessment. However, it is not uncommon for additional work to be required due to unforeseen damage in the ground, hidden complexities within the reticulation system, or the discovery of additional leaks or faulty components.

 

Factors such as underground obstacles, deteriorated components, or soil conditions may only become apparent during the actual work. Additionally, the exploration of the reticulation system may reveal previously undetected leaks or faulty components that require attention to rectify the initial problem.

Therefore, the quote provided by Retic Smart is more accurately described as an estimate rather than a fixed price. We aim to be transparent about this aspect of our quoting process to ensure clarity for our customers.

Any deviations from the original scope of work or requests for additional work beyond what was agreed upon will necessitate a written change order and additional compensation, unless a verbal agreement is reached due to exceptional circumstances where generating a revised quote is not feasible.

Any alterations to the original scope of work must be mutually agreed upon, either in writing or verbally, by both the Customer and Retic Smart. Retic Smart is not obligated to perform any work that falls outside the original scope or that has not been explicitly agreed upon by both parties.

​

In the event that unforeseen repairs to the reticulation system arise, which were not accounted for in the initial quote, Retic Smart will promptly notify the Customer. The Customer will then have the following options:

​

  1. Approve the unforeseen repairs and compensate Retic Smart for the additional work. In this case, any completed work and time spent on the job up to that point will be invoiced to the Customer at the agreed-upon rate.

  2. Decline the unforeseen repairs. In such cases, if the completion of the original scope of work becomes impossible due to the nature of the repair, Retic Smart reserves the right to void all existing contracts. The customer will be invoiced for any completed work and time spent on the job up to that point.

 

Should the Customer decline the unforeseen repairs, Retic Smart will not be held liable for any resulting damage or loss. Retic Smart reserves the right to refuse requests for additional work that falls outside the agreed-upon scope or poses potential safety hazards or technical challenges.

 

Any additional work carried out in accordance with this section will be subject to the same payment terms as the original contract.

External Contractors

​

At Retic Smart, we may occasionally engage subcontractors or external contractors, such as electricians, to assist in completing certain aspects of the work required for your project. While we carefully select and supervise these contractors to ensure quality and reliability, it's important to clarify our policy regarding their work:

​

  • Warranty Exclusion: Please note that Retic Smart does not warranty the work performed by subcontractors or external contractors. Any warranties or guarantees provided by these subcontractors or external contractors are separate from and independent of Retic Smart's warranty terms.

  • Liability Limitation: Retic Smart shall not be liable for any damages, losses, or issues arising from the work performed by subcontractors or external contractors. This includes, but is not limited to, damages to property, malfunctioning components, or personal injury resulting from the subcontractor's or external contractor's work.

 

If you have any questions or require further clarification regarding subcontractor or external contractor arrangements, please don't hesitate to contact us.

Liability

 

While Retic Smart strives to provide high-quality services, it's important to acknowledge the shared responsibility between Retic Smart and the Customer in ensuring the proper use and maintenance of the reticulation system.

​

The Customer accepts responsibility for utilizing the irrigation system correctly and adhering to the manufacturer's instructions. It is understood that improper use or programming of the irrigation system may result in damage to the lawn and garden. Therefore, Retic Smart shall not be held liable for any loss or damage arising from the Customer's incorrect use or programming of the irrigation system after installation, except in cases of Retic Smart's negligence or willful misconduct.

Retic Smart shall not be liable for any loss or damage, including but not limited to loss of property, loss of profits, or personal injury, resulting from the incorrect use or programming of the irrigation system, except to the extent that such loss or damage is directly caused by Retic Smart's negligence or willful misconduct.

Controller Reprogramming

 

Retic Smart is committed to ensuring the optimal performance of your reticulation system. For newly installed controllers, we take responsibility for programming them in accordance with the Water Corporation's Waterwise scheduling guidelines. This ensures efficient water usage and adherence to local regulations.

​

Following the installation and programming of a new controller, or in instances where your reticulation system undergoes repair or servicing by Retic Smart, the responsibility for reprogramming the controller shifts to the resident.

​

We understand that proper programming is crucial for the effective functioning of your irrigation system. If you require assistance with reprogramming your controller after a repair or service, Retic Smart offers a reprogramming service at an additional cost. This service ensures that your system continues to operate optimally, tailored to your specific needs and preferences. We are happy to provide guidance on adjusting your reticulation schedule through the manufacturer's instructions.

 

Smart Home Integration

 

Retic Smart is committed to assisting you with the setup of your controller on up to two smart devices simultaneously on the day of installation. Please note that this service does not extend to the integration with smart home ecosystems such as Google Home, Google Assistant, Apple Homekit, Siri, Amazon Alexa, etc.

 

The integration of your reticulation system with smart home ecosystems is the responsibility of the resident after the installation. Retic Smart will gladly provide guidance on finding and following the manufacturer's instructions for integration.

 

Should additional setup assistance be required beyond what was provided on the installation day, we offer the option for a quoted service at an additional cost.

 

Returns Policy for Faulty Items

 

If you receive a faulty item, please contact us immediately and we will arrange for a replacement or refund if it is in accordance with the manufacturer's conditions for eligibility.

​

No-Returns Policy for Change of Mind

 

Please be advised that we do not accept returns due to a change of mind after installation. This policy means that items cannot be returned simply because you no longer want them or have decided to purchase something else instead.

 

It's important to note that this policy does not affect your rights under Australian Consumer Law. If you encounter any issues with your product or service, please contact us, and we will do our best to assist you in accordance with applicable consumer rights.

Water Restrictions

​

At Retic Smart, we understand the importance of keeping your garden vibrant and healthy. We also recognize the responsibility we share to conserve water, a precious resource. To achieve this balance, we align our watering schedules with the current water restrictions outlined by the Water Corporation of Western Australia. Rest assured, this collaboration offers several benefits:

​

  • Following water restrictions ensures responsible use of water, which is vital for environmental protection and long-term sustainability. By working together, we contribute to a greener future for everyone.

  • Adherence to the guidelines also helps avoid potential penalties associated with exceeding water allowances.

  • Even within these restrictions, we strive to create optimal watering schedules for your garden. If you have specific concerns, please don't hesitate to discuss them with our team. 

 

While we cannot be held liable for plant damage arising from water restrictions, we remain committed to your satisfaction. We believe in open communication and collaboration. If you have any questions or concerns, please feel free to reach out. We're here to help you navigate water restrictions and maintain a beautiful, healthy garden responsibly.

Additionally, if you have certain plants with specific watering needs that exceed the limitations set by the water restrictions, you can always supplement their watering by hand. This way, you can ensure the continued health of your prized plants while still adhering to the overall water conservation guidelines.

 

Loss or Damages

​

Retic Smart is not liable for any loss or damage, including but not limited to, loss of property, loss of profits, or personal injury, arising from the incorrect use or programming of the irrigation system, except to the extent that such loss or damage is caused by Retic Smart's negligence or willful misconduct.
